By accessing or using GroovyPatterns.com, its products, or directly or indirectly requesting any services, you agree to be bound by these Terms of Use. Groovy Patterns reserves the right to make changes to these Terms of Use, products, services, and pricing at any time without prior notice. We encourage you to review these Terms of Use each time you access our site or request services.

1. Products and Services Overview
Groovy Patterns specializes in designing and crafting high-quality, durable plastic groovy boards and robust 24-pound paper pantographs. All our products are proudly designed and manufactured in-house by our family-run operation in Mid-Michigan, USA.
• Product Usage: Groovy Patterns products are intended solely for personal or professional longarm quilting services.
• Reproduction Prohibition: The reproduction or replication of our boards or designs is strictly prohibited.
• Product Features: As of 2024, our groovy boards include registration marks (except for some self-aligning designs) and come with six non-slip silicone grips at no additional cost.
• "As Is Lots": We occasionally offer discounted "As Is Lots" for products with cosmetic flaws that do not affect their functionality.
• Gift Cards: Digital gift cards are available for purchase.

2. Custom Design Services
Groovy Patterns offers custom design services for groovy boards, allowing for unique personalization.
• Customization Options: Our custom designs can be tailored to your specific needs, including size adjustments, themed designs, incorporating your business logo or name, personal signatures or handwriting, and transforming inspiring images into custom creations.
• Request Process: To request a custom design, please email us your detailed request, including any relevant images, to quilting@groovypatterns.com. We work on a first-come, first-served basis, and timing for design creation may vary based on complexity.
• Design Fees: Most minor modifications to existing designs are offered at no extra cost. However, one-of-a-kind custom designs may incur a design fee.
• Your Content Responsibility: If you provide any text, images, designs, or other content for your custom project, you unconditionally guarantee that you possess all necessary rights and authority to use such content. You further warrant that Groovy Patterns' use of this content will not infringe upon any trademark, copyright, or other intellectual property rights of any third party.
• Groovy Patterns' Intellectual Property Rights: You acknowledge that you obtain no right or claim of any kind to any individual design (or any element thereof) provided by Groovy Patterns as part of your custom project. Groovy Patterns retains all rights in all Custom Design work product, including both final and draft designs, and reserves the right to use the same or similar designs or elements for other custom projects or other parties in the future.
• Project Refusal or Termination: Groovy Patterns reserves the right, at its sole discretion, to refuse any custom design project or terminate it prior to completion for any reason. We shall have no liability of any kind to you or any third party arising from such refusal or termination.
• Promotional Use of Designs: Groovy Patterns reserves the right to use any designs created for your custom project and/or your finished products as samples for advertising, promotional, and internal purposes.
• Cancellation Policy for Custom Designs: Custom design projects may be cancelled within 10 days of the initial designs being completed by the Groovy Patterns team and placed in your account. If you do not cancel within this 10-day period, you will be deemed to have accepted the designs, and all amounts paid or payable for the custom design project will be nonrefundable. All cancellation requests must be sent via email to quilting@groovypatterns.com.
• Delivery Time Estimates: All delivery times provided for custom design projects are estimates only. Groovy Patterns is not responsible for any late projects or any impact delays may have on your business.
• Legal Advice Responsibility: Groovy Patterns provides no warranty that any design will not infringe upon the trademark or other rights of another party. It is solely your responsibility to obtain legal advice regarding whether any such design is legally available for your use and does not infringe third-party rights.

3. General Sales Terms (for Direct-to-Consumer Purchases)
• Shipping Policy: For U.S. orders, we offer free shipping on orders over $99. Orders below $99 incur a flat rate of $5. Shipments to Canada have a flat rate of $50. Shipping methods are subject to change.
• Returns and Exchanges: We strive for complete transparency in our product listings to ensure customer satisfaction and minimize the need for returns. We provide detailed product dimensions and multiple photos for every design. Please review all specifications carefully before making a purchase. If purchasing as a gift, we recommend considering a gift card or confirming the recipient's preferences in advance, as exchanges and returns are generally not offered.
• Customer Responsibilities: You are responsible for contacting Groovy Patterns with any changes, updates, or enhancements related to your order from the date of sale.

4. Wholesale Terms & Conditions (For Business Partners)
This section applies to all wholesale account holders. Groovy Patterns is actively seeking partnerships with independent, specialty quilt shops and larger online retailers.
• Application Process: Interested businesses should contact Groovy Patterns directly for information on our wholesale program. We look for partners who align with our commitment to product quality and customer service.
• Minimum Order Requirements: Wholesale orders will be subject to minimum order values. Specific details regarding initial and re-order minimums will be provided upon application.
• Pricing: Wholesale pricing, along with recommended retail pricing, will be provided in our wholesale catalog.
• Shipping for Wholesale: Shipping costs and methods for wholesale orders will be outlined in our wholesale terms.
• Returns and Cancellations for Wholesale: Specific policies for returns and cancellations on wholesale orders will be provided upon application.
• Changes to Wholesale Terms: Groovy Patterns reserves the right to make changes to these wholesale terms and conditions, as well as to wholesale products, prices, shipping methods, and returns policies, at any time. Current wholesale account holders will be notified of such changes.

Groovy Patterns disclaims and shall not be liable for any loss, injury, cost, or damage suffered by the customer or any third party, and shall in no event be liable for consequential, special, indirect, or incidental damages (including without limitation, damages for loss of business profits, business interruption, or loss of data), arising out of or in any way connected with the use of the designs and any information available on or related to such designs, and the delay or inability to use the Groovy Patterns site or any information, in each case even if Groovy Patterns has been advised of the possibility of such damages.
